Terms of Use

Effective Date: 27 April 2022

This page states the terms of use (“Terms”) under which you (“You”) may use the X0PA Website and X0PA Platforms, and Your relationship with X0PA AI Pte Ltd (“X0PA”, “we” or “us”). Please read them carefully as they affect Your rights and liabilities under the law. If You do not agree to these Terms, please do not register for or use the X0PA Websites and X0PA Platforms. These Terms are effective as of 20 April 2022. If You have any questions on the Terms, please contact us with the information provided in Clause X below or via the “Contact Us” page in X0PA Website.

  1. Binding Agreement
  1. This X0PA Website is provided to you for your use subject to these Terms. These Terms form a binding agreement between you and X0PA. By accessing or using the X0PA Website you agree to accept and/or to be bound by these Terms. you agree to use the X0PA Website at your own risk.
  2. In the case of any conflict between these Terms and any contract you have with X0PA, these Terms will take precedent.
  3. We may update these Terms from time to time for legal or regulatory reasons or to allow the proper operation of the X0PA Website and X0PA Platforms. Any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the X0PA Website. The changes will apply to the use of the X0PA Website after we have given you notice. If you do not wish to accept the new Terms you should not continue to use the X0PA Website. If you continue to use the X0PA Website after the date on which the change comes into effect, your use of the X0PA Website indicates your agreement to be bound by the new Terms.
  1. Definitions
  1. “Data Controller” is an individual or organization that makes decisions on how personal data is collected, used, or disclosed. This includes determining the purposes for which the personal data is collected, the manner in which it is collected, and the recipients to whom it may be disclosed. In essence, a data controller has overall responsibility for ensuring that personal data is processed in compliance with the PDPA.
  2. “Data Intermediary” is an individual or organization that processes personal data on behalf of a data controller. This includes any person who processes personal data under the instructions of a data controller, such as a third-party service provider or a data processing agent. Data intermediaries are subject to specific obligations under the PDPA to ensure that personal data is handled in accordance with the requirements of the Act.
  3. “Design” includes the color combinations and the page layout of the X0PA Website and X0PA Platforms.
  4. “Employer” or “Employers” means a person or entity that is accessing a X0PA Website to post a job or utilizing the X0PA Services for any reason related to the purpose of seeking candidates for employment.
  5. “Employer Materials” includes any brochures, emails, job postings, web site content, career fair material, audio, videos, photographs, logos, trademarks, service marks, domain names, documents or other materials provided by Employer, if any, for use in connection with the X0PA Services.
  6. “Graphics” includes all logos, button icons, and other graphical elements on the X0PA Website and X0PA Platforms, with the exception of paid advertising banners.
  7. “Candidate” or “Candidates” means a User who is accessing a X0PA Platform to search for a job or in any other capacity except as an Employer.
  8. “Company Profiles” means profile created by Employers.
  9. “X0PA” means X0PA AI Pte Ltd or the company operating the X0PA Website and X0PA Platforms for the country in which you live or in which business is headquartered.
  10. “X0PA Content” includes all Text, Graphics, Design, Programming, information, images, video, audio files, software and other contents used on the X0PA Website and X0PA Platforms.
  11. “X0PA Database” or “X0PA Databases” includes all job advertisement posted on X0PA Websites and/or all candidates and/or employers’ information registered with X0PA.
  12. “X0PA Profile” or “X0PA Profiles” means the profile created by Candidates that may include personal information, resume and photo.
  13. “X0PA Resume Database” or “Resume Database” means the candidates X0PA Profiles and resume created and/or uploaded into X0PA databases.
  14. “X0PA Services” means any services provided by X0PA or its agents including:-
  1. the provision of online job site, including posting and searching for employment opportunities, and creating X0PA Profiles and Company Profiles which may include personal information;
  2. the provision of talent sourcing services;
  3. the provision of online resume search access;
  4. matching of job specifications with potential candidate X0PA Profiles and advising Users and/or Candidates of the positions available;
  5. providing Employers with other ancillary talent sourcing and advertising services including banners, electronic direct mail system, design and posting support services; and
  6. providing Employers services to post jobs, screen, interview and hire candidates on X0PA Platforms.
  1. “X0PA Website” means any website under X0PA’s control, including:
  1. https://x0pa.com
  2. https://x0paroom.com
  1. “X0PA Platforms” means the various platform products and websites such as AI Recruiter, X0PA Room, and AI Academia.
  2. “Profiles” means individual profiles created by Users and/or Candidates or company profiles created by Employers.
  3. “Programming” includes both client-side code (HTML, JavaScript, etc.) and server-side code (Active Server Pages, VBScript, databases, etc.) used on the X0PA Website.
  4. “Text” includes all text on every page of the X0PA Website and X0PA Platforms, whether editorial, navigational, or instructional.
  5. “User” refers to any individual or entity that uses any aspect of the X0PA Website and/or X0PA Platforms.
  6. “User Content” means all information, data, text, software, music, sound, photographs, graphics, video, advertisements, messages or other materials submitted, posted or displayed by Users on or through X0PA Website and X0PA Platforms.
  7. “You” or “you” means the person who (or the entity on behalf of whom you are acting) that is agreeing to these Terms.
  1. Registration
  1. To register on the X0PA Website and X0PA Platforms you must be 15 years of age or above.
  2. You must ensure that the details provided by you on registration or at any time are correct and complete.
  3. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.
  1. Password and security
  1. When you register to use the X0PA Platforms you will be asked to create a password. In order to prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password you should notify us by contacting us here immediately.
  2. If X0PA has reason to believe that there is likely to be a breach of security or misuse of the X0PA Platforms, we may require you to change your password or we may suspend your account.
  3. As a result of your loss of your Password or the misuse of the X0PA Platforms:
  4. all losses or damage incurred thereby shall be borne by you; and
  5. you shall fully indemnify X0PA should X0PA suffer any loss or damage.
  1. Intellectual Property
  1. X0PA Website, X0PA Platforms, X0PA Content, and all right, title and interest in and to X0PA Website, X0PA Platforms and X0PA Content are the exclusive property of X0PA or its licensors.
  2. X0PA Website, X0PA Platforms and X0PA Content are protected by copyright, trademark, database right and other intellectual property rights.
  3. You may retrieve and display X0PA. Content of the X0PA Website or X0PA Platforms on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or X0PA Content on the X0PA Website or X0PA Platforms without written permission from X0PA.
  1. Availability of the X0PA Website and X0PA Platforms
  1. Although we aim to offer you the best service possible, we make no promise that the services at the X0PA Website or X0PA Platforms will meet your requirements.
  2. We cannot guarantee that the X0PA Website or X0PA Platforms will be fault-free, error-free, or that X0PA Website, X0PA Platforms and servers are free of viruses or other harmful mechanisms. If a fault occurs with the X0PA Website or X0PA Platforms, you should report it here and we will attempt to correct the fault as soon as we can.
  3. Your access to the X0PA Website or X0PA Platforms may be occasionally restricted to allow for repairs, maintenance or the introduction of new content, facilities or services. We will attempt to restore access and/or service as soon as we reasonably can.
  1. Your use of the X0PA Platforms
  1. X0PA hereby grants you a limited, terminable, non-exclusive right to access and use X0PA Website and X0PA Platforms only for your personal use and/or employment purposes.
  2. You may not use the X0PA Website or X0PA Platforms for any of the following purposes:-
  1. disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;
  2. aggregating, copying or duplicating in any manner any of the X0PA Content or information available from any X0PA Website or X0PA Platforms, including expired job postings;
  3. reproducing any of the X0PA Content for general use;
  4. link to any X0PA Content or information available from any X0PA Website or X0PA Platforms;
  5. transmitting material that encourages conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or code of practice;
  6. interfering with any other person’s use or enjoyment of the X0PA Website or X0PA Platforms; or
  7. making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.
  1. You agree not to resell or assign your rights or obligations under these Terms. You also agree not to make any unauthorized commercial use of any X0PA Website, X0PA Platforms or X0PA Content.
  1. Your use of the X0PA Services
  1. The X0PA Services may be used only by:
  1. individuals seeking employment, and career and career-related information, such as education and voluntary services; and
  2. Employers or their agents seeking candidates for employment purposes.
  1. Your use of the X0PA Services is also subject to any other contracts you may have with X0PA. In the case of any conflict between these Terms and any contract you have with X0PA, these Terms will prevail.
  2. All Users agree to not:-
  1. transmit, post, distribute, store or destroy material, including without limitation X0PA Content, in violation of any applicable law or regulation, including but not limited to laws or regulations governing the collection, processing, or transfer of personal information, or in breach of X0PA’s Privacy Policy;
  2. violate or attempt to violate the security of any X0PA Website or X0PA Platforms;
  3. reverse engineer or decompile any parts of any X0PA Website or X0PA Platforms;
  4. aggregate, copy or duplicate in any matter any of the X0PA Content or information available from any X0PA Website or X0PA Platforms, including expired job postings, other than as permitted by these Terms;
  5. post any content or material that facilitates, promotes or endorses scams, false or misleading information or illegal activities, OR endorses or provides instructional information about illegal activities or other activities prohibited by these Terms, such as making or buying illegal weapons, violating someone’s privacy, providing or creating computer viruses or pirating media, OR promotes or endorses any political views;
  6. post any profile, resume or apply for any job on behalf of another party;
  7. share with a third party any login credentials to any X0PA Platforms;
  8. access data not intended for you or logging into a server or account which you are not authorized to access;
  9. post or submit to any X0PA Platforms any inaccurate, incomplete, misleading, false, not up to date biographical information or information which is not your own;
  10. post content that contains restricted or password-only access pages, or hidden pages or images;
  11. solicit passwords or personally identifiable information from other Users;
  12. delete or alter any material posted by any other person or entity;
  13. harass, incite harassment or advocate harassment of any group, company or individual;
  14. send unsolicited mail or email, make unsolicited phone calls or send unsolicited faxes promoting and/or advertising products or services to any User, or contact any users that have specifically requested not to be contacted by you;
  15. attempt to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to any X0PA Website or X0PA Platforms, overloading, “flooding”, “spamming”, “mailbombing”, or “crashing”.
  16. use the X0PA Services for any unlawful purpose or illegal activity, or post or submit any content, profile,  resume, or job posting that is defamatory, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, harassing, abusive, hateful, racist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind, as determined by X0PA’s discretion; or
  17. post any profile or resume which is not a genuine profile or resume and which attempts to advertise or promote products or services.
  1. Violations of network security may result in civil and/or criminal liability. X0PA will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.
  1. Additional Terms applicable to Employers
  1. X0PA hereby grants you a limited, terminable, non-exclusive right to access and use X0PA Website and X0PA Platforms for your internal business use seeking candidates for employment. This authorizes you to view and download a single copy of X0PA Content or materials on X0PA Platforms solely for your use directly related to searching for and recruiting Candidates.
  2. X0PA also grants you a limited, terminable, non-exclusive right to use X0PA Services for your internal use only.
  3. You are responsible for maintaining the confidentiality of your Employer account, Company Profiles and passwords, as applicable.
  4. You may not share your password or other account access information with any other party, temporarily or permanently, and you shall be strictly liable and/or responsible for all uses of your X0PA Platforms registrations and passwords, whether or not authorized by you.
  5. You agree to immediately notify X0PA of any unauthorized use of your employer account, Company Profiles or passwords.
  6. Employer represents, warrants and covenants that any Employer Materials provided by Employer for use in connection with X0PA Services will not violate any laws or regulations or third-party proprietary rights, including, without limitation, copyright, trade mark, obscenity, rights or publicity or privacy, and defamation laws.
  7. Employers acknowledge and agree that it shall disregard any personal data received from the Candidate which are irrelevant to obtaining and assessing the suitability of candidates.
  8. Employers are solely responsible for the Employer Materials on X0PA Platforms. X0PA is not to be considered to be an employer with respect to your use of any X0PA Platforms and X0PA shall not be responsible for any employment decisions, for whatever reasons, made by any entity posting jobs on any X0PA Platforms.
  9. Employer Materials may not contain:-
  1. misleading, unreadable, or “hidden” keywords, repeated keywords or keywords that are irrelevant to the job opportunity being presented;
  2. names, logos or trademarks of unaffiliated companies;
  3. inaccurate, false, or misleading information; and
  4. material or links to material that is discriminatory, sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive, or hateful, or solicits personal information from anyone under 18.
  1. You may not use your Employer Materials to:-
  1. post jobs in a manner that does not comply with applicable local, national laws, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property;
  2. sell, promote or advertise products or services;
  3. post any franchise, pyramid scheme, distributorship, or multi-level marketing opportunity;
  4. promote any opportunity that does not represent bona fide employment; and
  5. advertise sexual services or seek employees for jobs of a sexual nature.
  1. X0PA does not encourage any Employer Materials on X0PA Website that request Candidates to pay deposits, placement fees, processing fees or any other similar fees, directly or indirectly, and/or require Candidates to make purchases.
  2. X0PA is under no obligation to monitor the Employer Materials on X0PA Website, but X0PA may monitor the Employer Materials at random.
  3. X0PA reserves the right to remove any Employer Materials or content from any X0PA Website, which in the reasonable exercise of X0PA’s discretion, does not comply with this Section, or if any content is posted that X0PA believes is not in the best interest of X0PA.
  4. If any time during your use of the X0PA Services, you made a misrepresentation of fact to X0PA or otherwise misled X0PA in regards to the nature of your business activities or breach of the Terms herein, X0PA may terminate your use of the X0PA Services and in such event, any payment made by you shall be forfeited.
  5. You understand and acknowledge that if you cancel your Employer account or your Employer account is terminated, all your account information from X0PA, including saved X0PA Profiles and resumes, network contacts, and email mailing lists, will be marked as deleted in and may be deleted from X0PA Databases. Information may continue to be available for some period of time because of delays in propagating such deletion through X0PA’s web servers.
  6. As a Data Intermediary, X0PA will adopt your data retention policies for the Candidates applying to your jobs. In the event of any requests from Candidates to access and correct their information or withdraw their consent, you shall promptly notify us with the relevant info to process the request.
  1. Additional Terms applicable to X0PA Resume Database Users
  1. If you are registering for and/or paying for access to the X0PA Resume Database, this Section applies to you.
  2. You must be 18 years of age or above.
  3. You shall use the X0PA Resume Database as provided in these Terms, in any contract you have with X0PA, and in compliance with all laws including laws governing personal data.
  4. X0PA grants you a limited, personal, terminable, non-transferable, non-exclusive right to access X0PA Resume Database via X0PA Website for the purpose of viewing and/or downloading a single copy of available X0PA Profiles and resumes solely for your use subject to the provisions of this Section.
  5. X0PA Resume Database is to be accessed and used solely by you. You will be provided with a unique password that will permit you to access the Resume Database.
  6. You shall not share your account with any other party.
  7. You agree that you shall not disclose any of the data from X0PA Resume Database to any third party, unless you are an authorized recruitment agency, or staffing agency or using X0PA Profiles and resume explicitly for employment purposes.
  8. You shall take appropriate physical, technical, and administrative measures to protect the data you have obtained from X0PA Resume Database from loss, misuse, unauthorized access, disclosure alteration or destruction.
  9. The X0PA Resume Database shall not be used:-
  1. for any purpose other than as an employer and/or on behalf of an employer seeking employees; or
  2. to make unsolicited phone calls or faxes or send unsolicited mail, email, or newsletter to X0PA Profile or resume holders or to contact any individual unless they have agreed to be contacted.
  1. The data obtained from the X0PA Resume Database shall not be kept longer than is necessary for the fulfillment of the purposes set out in this Section. In this respect, you agree and undertake to delete, destroy and/or purge such data from your records.
  2. You may not use X0PA Resume Database in any way which, in X0PA’s sole judgment, adversely affects X0PA’s business, business prospects, the performance or function of any of X0PA Platforms or X0PA Resume Database, or interferes with the ability, of other subscribers to access the Resume Database.
  3. In order to ensure a safe and effective experience for all of our customers, X0PA reserves the right to limit the amount of data (including X0PA Profile and resume views) that may be accessed by or provided to you in any given time period. These limits may be amended in X0PA’s sole discretion from time to time.
  4. You may use your subscription to X0PA Resume Database only for seeking candidates for employment. You are specifically prohibited from using information contained in X0PA Resume Database to sell or promote any products or services or to take any other action that is, in X0PA’s sole judgment, inconsistent with these Terms, misleading or incomplete, or in violation of any laws or regulations.
  5. X0PA may terminate, suspend, update, alter or supplement, at its sole discretion, all or any part of X0PA Resume Database at any time. By permitting access to X0PA Resume Database, X0PA does not convey any interest in or to the Resume Database or any other X0PA property or Services. All right, interest in and to the Resume Database is and shall remain in X0PA.
  1. Additional Terms applicable to Candidates
  1. X0PA hereby grants you a limited, terminable, non-exclusive right to access and use X0PA Platforms only for your personal use seeking employment opportunities for yourself. This authorizes you to view and download a single copy of the X0PA Content or material on X0PA Website solely for your personal, non-commercial use.
  2. When you register with any X0PA Platforms, you will be asked to create an account and provide X0PA with certain information including a valid email address.
  3. Any X0PA Profile you submit must be accurate, complete, up to date and not misleading. The X0PA Profile requires standard fields to be completed by you. You may not impersonate another person, living or dead.
  4. You acknowledge and agree that you are solely responsible for the form, content and accuracy of any X0PA Profile and resume or material contained therein placed by you on the X0PA Platforms.
  5. You acknowledge and agree that you are solely responsible for any consequences arising from such posting.
  6. X0PA reserves the right to offer third party services and products to you based on the preferences that you identify in your registration and at any time thereafter or you have agreed to receive, such offers may be made by X0PA or by third parties.
  7. Please see X0PA’s Privacy Policy, for further details regarding your information. Please note, as set forth in the X0PA’s Privacy Policy, that X0PA may collect certain User information and may contact Users periodically in accordance with the terms of the Privacy Policy. In addition, X0PA reserves the right to comply, in its sole discretion, with legal requirements, requests from law enforcement agencies or requests from government entities, even to the extent that such compliance may require disclosure of certain User information. In addition, third parties may retain cached copies of User information.
  8. You understand and acknowledge that all information provided by you, your X0PA Profile, resume, and/or account information shall be disclosed to prospective Employers.
  9. You understand and acknowledge that you have no ownership rights in your account and that if you cancel your X0PA account or your X0PA Account is terminated, all your account information from X0PA, including X0PA Profile, resumes, cover letters, saved jobs, will be marked as deleted in and may be deleted from X0PA Databases and will be removed from any public area of the X0PA Website or X0PA Platforms. Information may continue to be available for some period of time because of delays in propagating such deletion through X0PA’s web servers. In addition, third parties may retain saved copies of your information.
  10. X0PA reserves the right to delete your account and all of your information after a significant duration of inactivity. X0PA’s data retention policy is stated in the Privacy Policy.
  11. Where X0PA is acting as a Data Intermediary in processing data on behalf of a Data Controller, X0PA will adopt the retention policy of the Data Controller.
  12. You reserve the rights to access, correct and withdraw your information provided to X0PA. If you applied through another company which is using X0PA as a platform or Data Intermediary, please direct your request to the company instead. We will only process the request upon the instruction of the company (Data Controller). Please refer to the Privacy Policy for the access, correct and withdrawal process.
  1. User Content and submissions
  1. You understand that all User Content is the sole responsibility of the person from which such User Content originated.
  2. You understand and acknowledge that all information provided by you, your X0PA Profile, resume, and/or account information shall be stored in X0PA Databases and/or X0PA Resume Databases.
  3. You understand, acknowledge and consent that all information provided by you, your X0PA Profile, resume, and/or account information may be transferred to countries outside of your location for the purposes of storing and/or processing. Please see X0PA’s Privacy Policy, for further details.
  4. By submitting, posting or displaying User Content on or through X0PA Platforms, you grant X0PA, subject to your privacy setting, a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such User Content through X0PA Platforms. X0PA will discontinue this licensed use within a commercially reasonable period after such User Content is removed from X0PA Website. X0PA reserves the right to refuse to accept, post, display or transmit any User Content in its sole discretion.
  5. If you post User Content in any public area of any X0PA Website or X0PA Platforms, you also permit any User to access, view, store and reproduce such User Content for personal use.
  6. X0PA may review and remove any User Content that, in its sole judgment, violates these Terms, violates applicable laws, rules or regulations, is abusive, disruptive, offensive or illegal, or violates the rights of, or harms or threatens the safety of, Users of any X0PA Website or X0PA Platforms. X0PA reserves the right to expel Users and prevent their further access to the X0PA Website or X0PA Platforms and/or use of X0PA Services for violating the Terms or applicable laws, rules or regulations. X0PA may take any action with respect to User Content that it deems necessary or appropriate in its sole discretion if it believes that such User Content could create liability for X0PA, damage X0PA’s brand or public image, or cause X0PA to lose Users.
  7. X0PA does not represent or guarantee the truthfulness, accuracy, or reliability of User Content, derivative works from User Content, or any other communications posted by Users nor does X0PA endorse any opinions expressed by Users. You acknowledge that any reliance on material posted by other Users will be at your own risk.
  1. X0PA’s right to suspend or cancel your registration
  1. We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms.
  2. You can cancel your registration at any time by informing us in writing here. If you do so, you must stop using the X0PA Platforms.
  3. The suspension or cancellation of your registration and your right to use the X0PA Platforms shall not affect either party’s statutory rights or liabilities.
  1. Term and Termination
  1. These Terms will remain in full force and effect while you are a user of any X0PA Website.
  2. X0PA reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to removal of your User Content from the X0PA Website and immediate termination of your registration with or ability to access the X0PA Website and/or any other services provided to you by X0PA, upon any breach by you of these Terms or if X0PA is unable to verify or authenticate any information you submit to a X0PA Website registration.
  3. Even after you are no longer a User of the X0PA Website or X0PA Platforms, certain provisions of these Terms will remain in effect, including Sections 5, 13, 15, 16, 17 and 19, inclusive.
  1. X0PA’s liability
  1. X0PA Website and X0PA Services act as, among other things, venues for:-
  1. Employers or their agents to post job opportunities and search for and evaluate job candidates; and
  2. candidates to post X0PA Profiles and resumes and search for and evaluate job opportunities.
  1. X0PA does not screen or censor the listings, including X0PA Profiles offered. X0PA is not involved in the actual transaction between employers and candidates. As a result, X0PA is not responsible for User Content, the quality, safety or legality of the jobs or X0PA or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings and X0PA makes no representations about any jobs, X0PA Profiles, resumes or User Content on the X0PA Website and X0PA Platforms.
  2. X0PA reserves the right in its sole discretion to remove any User Content including but not limited to X0PA Profiles, Company Profiles, Employer Materials, or other material from the X0PA Website or X0PA Platforms from time to time. When X0PA exercises this discretion and there is a breach of these Terms by the User, any payment made by the User will be forfeited.

The X0PA Website and X0PA Platforms also provides content from other internet sites or resources and while X0PA tries to ensure that material included on the X0PA Website or X0PA Platforms is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. If X0PA is informed of any inaccuracies in the material on the X0PA Website or X0PA Platforms we will attempt to correct the inaccuracies as soon as we reasonably can.
  4. Note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the X0PA Platforms. By its very nature other people’s information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. The aggregate liability by X0PA to you for all claims arising from your use of X0PA Website, X0PA Platforms and/or X0PA Services shall be limited to the amount of the existing package fee subscribed to and paid by you and operative at that time, or in the event you are a Candidate, shall be limited to SGD50.

1.1 Monthly Subscriptions

  • Users can cancel their monthly subscription at any time through their account settings.
  • The cancellation will take effect at the end of the current billing cycle, and no refunds will be issued for the remaining days of that cycle.

1.2 Annual Subscriptions

  • Annual subscription cancellations can be requested by contacting our customer support team.
  • The cancellation will take effect at the end of the current annual period, and no refunds will be provided for early termination unless otherwise required by law.
2. Refund Eligibility

2.1 Refunds are generally not provided except under the following conditions:

  • Technical Issues: If the software has persistent technical failures that our support team is unable to resolve within 30 days of reporting.
  • Incorrect Charges: If you were incorrectly charged due to an error on our part.
  • Breach of Service Terms: If we terminate your subscription for reasons other than a breach of our Terms of Use by you, a prorated refund may be issued.
3. Refund Request Process

  • Our team will review the request and respond within 14 business days.
  • If approved, refunds will be processed within 30 business days and issued via the original payment method.
4. Compliance with Indian and Singaporean Laws

This Cancellation and Refund Policy is governed by and construed in accordance with the laws of Singapore and India, including but not limited to:

  • Singapore: Personal Data Protection Act (PDPA) and relevant e-commerce regulations.
  • India: Consumer Protection Act, 2019, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

  3. X0PA shall not be responsible for any breach of these Terms caused by circumstances beyond its reasonable control.

If any of these Terms shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms and all provision not affected by such invalidity or unenforceability shall remain in full force and effect.

X0PA has taken every reasonable steps to complied and will continue to comply with its obligations as a data processor arising from the data protection and privacy laws in force from time to time to the extent that those obligations are relevant to this Agreement. Further, we have taken steps to implement and shall maintain an information security program including reasonable administrative, technical and physical measures designed to secure and protect the confidentiality, integrity and availability of all Confidential Information while in such party’s possession against unauthorized, unlawful or accidental access, disclosure, transfer, destruction, loss or alteration. The term Confidential Information will not, however, include any information that identifies or directly relates to natural persons (“Personal Data”). Each party will exercise commercially reasonable efforts not to disclose any Personal Data to the other party and to restrict the other party’s access to its Personal Data, but if a party is given access to the other party’s Personal Data, the receiving party will protect such Personal Data using a reasonable standard of care.
